Back to the Drawing Board in Menards Firing Court Case

A circuit court in Eau Claire needs to do some more homework, before granting a new damage award to a Menards’ executive who was fired seven years ago.

That’s what the Third District Appellate Court in Wausau said today, when it threw out a one-point-two-million dollar judgment for Dawn Sands. The judges said the circuit court miscalculated her legal fees, and it did not consider enough evidence. Sands was fired in 2006 as the general counsel for the Menards’ home improvement giant. She sued for discrimination. A circuit court first ruled that she was entitled to over one-point-seven million dollars – and an appellate court said she should be re-hired. The State Supreme Court said Menards did not have to re-hire Sands, and it returned the case back to the circuit court where her award was cut by a half-million dollars. The circuit court was told to make a more detailed review.
