The State Government Accountability Board says the local cities and counties can ban weapons at the polls.
According to the GAB elections qualify as special events.
The justice department says since municipalities occupy different spaces for election day, they can ban weapons in those places.
The issue came up during the April election in Jackson County. Poll workers in Merrillan say a man wearing a gun in a holster made some people nervous when he voted that day. The clerk there says the man is a firm believer in the right to carry firearms.
