BRF Common Council Minutes

(9/5/13)  The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on September 3, 2013 at 6:00 P.M. 

Alderpersons Johnson, Herman, R. Eddy, Rahmlow, Olson, J. Eddy, Gearing-Lancaster and Chojnacki were present.  Mayor Danielson presided.

It was moved by Alderperson Chojnacki, seconded by Alderperson Olson to dispense with the reading of the minutes of the August 6, 2013 Common Council meeting.  Motion carried with Alderperson Johnson voting no.

CITIZENS IN ATTENDANCE

Curtis Biggar was in attendance and presented a housing development concept for an area along the east shore of the Black River on North Roosevelt Road or the west shore of the river.  Mr. Biggar also presented a concept for reconfiguring the downtown district.

COMMITTEE REPORTS

It was moved by Alderperson R. Eddy, seconded by Alderperson Rahmlow to place on file the Utility Commission minutes of August 26, 2013.  Motion carried.

It was moved by Alderperson Olson, seconded by Alderperson J. Eddy to approve the Committee of the Whole minutes of August 28, 2013.  Motion Carried.

It was moved by Alderperson Johnson, seconded by Alderperson Herman to approve the Conditional Use Permit and Variances to Fairway Outdoor Funding, LLC as applied for with the Plan Commission with the stipulation the signs not be illuminated.  Motion Carried.

OLD BUSINESS

Jackson County Circuit Court has withdrawn the request for the City to consider hiring an Adult/Youth Community Services Program Coordinator with reimbursement from the County.

NEW BUSINESS

Norm Stoker from the Township of Brockway presented problems his township is having with their lift station that handles waste from east of the Interstate including the Industrial Park.  Mr. Stoker advised they would like to explore the possibility of bypassing the failing lift station and free flowing in to the City's system.  Pending approval of their board, Brockway would assume all engineering expenses to have SEH, Inc. complete a study of the City's current system.

It was moved by Alderperson Olson, seconded by Alderperson Gearing-Lancaster to approve a Special Class "B" Retailer's License for Jackson County Little League for their Annual Co-ed Pumpkin Ball Tournament September 7, 2013 at 700 N. 10th Street – Marks Field.  Motion carried.

It was moved by Alderperson Johnson, seconded by Alderperson Chojnacki to approve the Library Board hiring of Tammy Peasley as the new Library Director.  Motion Carried.  Alderperson Rahmlow agreed with this hiring, but recommended revising the hiring notification process so candidates are not offered and accept the position before it is approved by the appropriate governing body.

It was moved by Alderperson J. Eddy, seconded by Alderperson Gearing-Lancaster to approve the Mayor's appointment of Nicole Schweitzer to the Library Board.  Motion Carried with Alderperson Olson voting no.

It was moved by Alderperson J. Eddy, seconded by Alderperson Chojnacki to approve Ordinance #816.  Motion Carried

CITY OF BLACK RIVER FALLS ORDINANCE NO. 816

AN ORDINANCE AMENDING THE CODE OF THE

CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN

BY REPEALING AND RECREATING SECTION 2.04(9)

            The Common Council of the City of Black River Falls, Jackson County, Wisconsin, do ordain as follows:

            SECTION 1.  Section 2.04(9) of the Code of Ordinances of the City of Black River Falls is repealed and recreated as follows:

(9)        COUNCIL AGENDA:  (a)  All reports, resolutions, ordinances or other written documents to be brought before the Council at its regular meeting shall be filed with the City Clerk by 4:00 p.m. on the Friday immediately preceding the regular Tuesday meeting.

            (b)        Any Council member may cause a resolution, ordinance, or discussion item to be placed on the Agenda by notifying the City Clerk not later than 4:00 p.m. on the Friday immediately preceding the regular Tuesday meeting.  A proposed agenda, together with relevant materials and communications, shall be prepared by the City Clerk and available to the Mayor, the Council members, and City officers required to attend regular meetings not later than 4:00 p.m. on the Monday prior to each regular Council meeting.  A similar agenda shall be prepared and delivered for special meetings of the Council if time permits.  No item may be acted on by the Council unless it is included in the agenda.  The proposed agenda together with relevant materials and communications shall be available at the Clerk's office for public inspection and copying by 4:00 p.m. on the Monday immediately preceding the regular Council meeting.  The agenda and materials for a special Council meeting shall be available as soon as prepared and assembled by the Clerk.

It was moved by Alderperson Gearing-Lancaster, seconded by Alderperson J. Eddy to approve Revision #1 to the Employee Handbook – Drug, Alcohol, and Narcotic-Free Work Place.  Motion Carried.

It was moved by Alderperson Olson, seconded by Alderperson Chojnacki to approve Amendment #1 to the Employee Handbook – Alcohol and Drug Testing Policy.  Motion Carried with Alderperson R. Eddy voting no.

It was moved by Alderperson Gearing-Lancaster, seconded by Alderperson Herman to approve Amendment #2 to the Employee Handbook – Prescription Reimbursement and Section 125.  Motion Carried.

It was moved by Alderperson Olson, seconded by Alderperson Chojnacki to approve Amendment #3 to the Employee Handbook – Organizational Chart.  Motion and second were rescinded after discussion.  Revisions to be made to the organizational chart.

-----------------------------------------------------------------------------------------------------------------------------------------------------The home located at 129 South First Street had been in the process of inspection and possible condemnation.  This property was sold at Sheriff's sale to WHEDA.  We will continue to monitor this property and pursue improvements.

The City's raze order deadline for the garage located at 303 South First Street has past.  The owner has made some recent improvements.  It was moved by Alderperson R. Eddy, seconded by Alderperson Johnson to have the City's Building Inspector re-inspect the garage at 303 South First Street for structural integrity.  Motion Carried.

The next Committee of the Whole meeting will be September 18, 2013 6:00 P.M.

It was moved by Alderperson Herman, seconded by Alderperson Johnson to adjourn in to closed session as authorized under Section 19.85(1)(f) of the Wisconsin Statutes.  Motion carried.
