BRF Common Council Minutes

(12/5/13)  The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on December 3, 2013 at 6:00 P.M.

  Alderpersons Johnson, Herman, R. Eddy, Rahmlow, Olson, J. Eddy, Gearing-Lancaster and Chojnacki were present.  Mayor Danielson presided.

It was moved by Alderperson Chojnacki, seconded by Alderperson Johnson to dispense with the reading of the minutes of the November 5, 2013 Common Council meeting and the November 21 23, 2013 Special Common Council meeting.  Motion carried.

COMMITTEE REPORTS

It was moved by Alderperson Olson, seconded by Alderperson Johnson to place on file the Plan Commission minutes of November 18, 2013.  Motion carried.

OLD BUSINESS

Discussion was held on Ordinance 817.  Jennifer Gunning, Tavern League member, expressed concerns about whether or not the ordinance allows the Council to issue warnings and whether the ordinance circumvents Section 125 regarding revocation of a liquor license.  City Attorney Dan Diehn advised language was included in the last line of the ordinance for the Council to give operators a reasonable opportunity to remedy the conditions, and advised this government body cannot circumvent Section 125.  The situations allowing for revocation under Section 125 are limited and this ordinance would allow the Council to take action on the conditions specified in the proposed ordinance. 

It was moved by Alderperson R. Eddy, seconded by Alderperson Johnson to approve Ordinance 817 Amending the Code of Black River Falls, Jackson County Wisconsin by Repealing and Recreating Section 12.02(4) Safety and Sanitation Requirements.   Motion Carried with Alderperson Olson abstaining.

CITY OF BLACK RIVER FALLS ORDINANCE NO. 817

AN ORDINANCE AMENDING THE CODE OF THE

CITY OF BLACK RIVER FALLS, JACKSON COUNTY, WISCONSIN

BY REPEALING AND RECREATING SECTION 12.02(4)

            The Common Council of the City of Black River Falls, Jackson County, Wisconsin, do ordain as follows:

            SECTION 1.  Section 12.02(4) of the Code of Ordinances of the City of Black River Falls is repealed and recreated as follows:

(4)        SAFETY AND SANITATION REQUIREMENTS:  Each licensed premises shall be maintained and conducted in a sanitary manner and shall be a safe and proper place for the purpose being used.  Each licensed premises shall be operated and maintained in a manner compliant to applicable State Code relative to building and sanitation and building and fire safety.

a)              The Chief of Police, or an agent appointed by the Chief, shall investigate all applications to ascertain if the same are proper and to ascertain if the granting of the application is consistent with the public interest of the City, including information as to whether there have been violations of the liquor and fermented malt beverage regulations, laws and rules of the City, or any other federal, State or local law directly related to the licensed activity.

b)             The City Council may refuse to issue or renew a license or may revoke or suspend an existing license for any operator or premises which fails to comply with this Section in a manner which creates a substantial risk of serious injury or illness to its employees, customers, or others lawfully on the licensed premises.  The City Council shall refuse to issue or renew a license under this subsection only after giving the operator a reasonable opportunity to remedy the relevant conditions.

Discussion on proposed Resolution 2013-6 Creating Housing Authority. Alderperson Gearing-Lancaster distributed additional information on homeless individuals and the need for a housing authority to Council members.  It was unclear what authority, if any, a housing authority would have to require landlords bring their property up to standards.  City Attorney Diehn explained the steps to create a housing authority were to pass a resolution and the Mayor appoints 5 members, and explained if the housing authority would want to purchase a property or complete a specific project then these actions would require approval by the Council. 

It was moved by Alderperson Chojnacki, seconded by Alderperson Gearing-Lancaster to adopt Resolution 2013-6 Creating a Housing Authority.  Motion carried with Alderpersons Herman, J. Eddy, Gearing-Lancaster, and Chojnacki voting yes and Alderpersons Johnson, R. Eddy, Rahmlow, and Olson voting no.  Mayor Danielson voted yes to break the tie vote.

NEW BUSINESS

It was moved by Alderperson Chojnacki, seconded by Alderperson Johnson to decline the request to use room tax funds to pay legal fees incurred by a hotelier. Motion Carried.

Sean Lentz with Ehlers & Associates presented a proposal to refinance the Fair Park/D&S Drive loan and the Rye Bluff Development loan.

It was moved by Alderperson Chojnacki, seconded by Alderperson Johnson to approve proceeding with the proposal presented and to have Sean come back to the January Council meeting with options. Motion Carried.

It was moved by Alderperson Olson, seconded by Alderperson J. Eddy to approve the Special Beer License Application for the Downtown Association for their Christkindl Festival December 6-7.  Motion Carried.

It was moved by Alderperson Rahmlow, seconded by Alderperson Johnson to approve the 5-year agreement between the City and the Rural Fire Department as presented.  Motion Carried.

It was moved by Alderperson J. Eddy, seconded by Alderperson Gearing-Lancaster to approve the 2014 BID Operational Plan, Budget, and Board appointments.  Motion Carried.

It was moved by Alderperson J. Eddy, seconded by Alderperson Johnson to approve the 2013-2014 Collective Bargaining Agreement between the City and the Professional EMT Association.  Motion Carried (8-0).

It was moved by Alderperson Rahmlow, seconded by Alderperson Chojnacki to approve the 2013-2014 Collective Bargaining Agreement between the City and the Professional Police Association.  Motion Carried (8-1) with Alderperson Johnson voting no.

It was moved by Alderperson Herman, seconded by Alderperson Johnson to adjourn in to Closed Session as authorized under Section 19.85(1)(c) of the Wisconsin Statutes.  Motion carried.
