BRF Common Council Meeting Minutes

The regular meeting of the Common Council was held at City Hall in the City of Black River Falls on February 4, 2014 at 6:00 P.M.  Alderpersons Johnson, Herman, R. Eddy, Rahmlow, Olson, J. Eddy, Gearing-Lancaster and Chojnacki were present.  Mayor Danielson presided.

It was moved by Alderperson Johnson, seconded by Alderperson Chojnacki to dispense with the reading of the minutes of the January 7, 2014 Common Council meeting.  Motion carried.

COMMITTEE REPORTS

It was moved by Alderperson R. Eddy, seconded by Alderperson Johnson to approve the Committee of the Whole minutes from January 15, 2014.  Motion carried.

The Committee of the Whole met at City Hall in the City of Black River Falls on January 15, 2014 at 6:00 P.M.  Alderpersons Johnson, Herman, R. Eddy, Rahmlow, J. Eddy, Gearing-Lancaster and Chojnacki were present.  Alderperson Olson was absent.  Mayor Danielson presided.

1.      The Department Head monthly reports were reviewed.  Department heads present were Tammy Peasley, Steve Schreiber, Todd Gomer, Steve Peterson, and Brad Chown. David Frederick absent due to injury and Jody Stoker absent due to training. 

2.      It was moved by Alderperson Johnson, seconded by Alderperson Herman to approve the Aquatics-Pool Manager and the Fair Park Facilities Assistant job descriptions as presented.  Motion Carried.

3.      City Administrator Brad Chown reported the Lunda Charitable Trust is requesting a five year agreement between the Trust and the City covering the operation and funding of the Lunda Community Park.  It was also reported that Nicholas Trujillo, Jr. had submitted nomination papers for 1st Ward Alderperson for the spring election but did not have enough signatures from the 1st Ward to certify his papers.  Mr. Trujillo's name will not appear on the ballot but he may still run a write in campaign but he would also need to move to the 1st Ward.  J&B Haldeman Holdings continue to make monthly interest payments to the City, but have filed for a 6 month extension on principle payments with the bankruptcy court. 

4.      Library Director Tammy Peasley reported the library received a grant for furniture which will be used to create a teen area in the library which will be completed during the three day closing at the end of February. 

5.      Fire Chief Steve Schreiber reported December was a busy month for his department, but they did have some good saves.  The cutover to narrow band radio system occurred today per FCC requirements.  Black River Camp members dug out fire hydrants and Gene Larson is planning on using the Street Department's small loader to dig out hydrants in the days to come.

6.      It was moved by Alderperson Johnson, seconded by Alderperson Chojnacki to approve 2014 Department Officers for the Fire Department as presented.  1st Asst. Chief – Darren Vase, 2nd Asst. Chief – Jody Stoker, 3rd Asst. Chief – Mark Nordahl, 1st Capt. – Justin Jessop, 2nd Capt. – Jennifer Amundson, 3rd Capt. – Collin Carriere, Secretary – Mark Nordahl, Treasurer – Jennifer Amundson.  Motion Carried.

7.      It was moved by Alderperson Johnson, seconded by Alderperson Herman to approve the EMT-EMR Joint Response Policy as presented in the EMS Division Chief's monthly report. Motion Carried.

8.      Street Superintendent Todd Gomer reported the large snow blower used to remove snow downtown has transmission problems that he hopes to have repaired in the next 2 days.  He requested a snow plow be installed on his city pick-up.  Cost would be approximately $6,000 and could be approved by the City Administrator.  There were no objections.  Explained snow removal was done in BID district, schools, churches, and some cul-de-sacs, and residents may contact private contractors for snow removal if needed.  Has not contacted the DOT regarding request for a bike lane on upper Main Street between 5th Street and 11th Street.  

9.      It was moved by Alderperson Chojnacki, seconded by Alderperson Gearing-Lancaster to adjourn.  Motion Carried.

It was moved by Alderperson Johnson, seconded by Alderperson J. Eddy to place on file the Utility Commission minutes from January 13, 2014 and January 27, 2014.  Motion Carried.

OLD BUSINESS

Mayor Danielson informed the Council that Alderperson Gearing-Lancaster and Alderperson Chojnacki had volunteered to be on the City Housing Authority.  They will be looking for three other members.  City residency is not required.

City Administrator Brad Chown updated the Council on two claims filed against the City by William Teeples.  Mr. Teeples filed an appeal to the WI Department of Workforce Development's (DWD) denial of unemployment benefits.  The appeal was denied upholding the denial of benefits.  Mr. Teeples had also filed a Retaliation Claim against the City with the WI DWD.  This complaint was dismissed by WI DWD.  Both claims are still subject to an appeals process open for 30 days.

NEW BUSINESS

It was moved by Alderperson Chojnacki, seconded by Alderperson Olson to approve the application for a Class B Retailer's Winery License for Buzz'n'Brew, LLC.  Motion Carried.

It was moved by Alderperson Gearing-Lancaster, seconded by Alderperson Olson to approve the application for a Temporary Class B Retailer's Beer & Wine License for Boys and GirlsClubJacksonCountyCenter for a beer & wine tasting fundraising event to be held at Sand Creek Brewery at 320 Pierce Street on March 22, 2014.  Motion Carried 7-1 with Alderperson Johnson voting no.

Police Chief Dave Frederick had submitted a request to fill an anticipated full-time patrol position vacancy.  The City Administrator was not aware of a resignation letter from the officer being submitted.  The Council chose to wait until a letter is received.  No action taken.

City Administrator Brad Chown advised the Council a general liability insurance claim against the city for a slip and fall in November 2013 had been paid by the insurance carrier.  The Council was also advised of two Worker's Compensation (W/C) claims within the city.  One claim is in the police department stemming from an auto accident.  The second claim is in the Street Department stemming from a fall from a vehicle.  Both W/C claims are still open at this time.

It was moved by Alderperson Johnson, seconded by Alderperson Chojnacki to approve the appointment of Samantha O'Donnell and Tamara Soto to the Room Tax Commission.  Motion Carried.

Mayor Danielson advised the Council the new name tags on the members' desks are prototypes and permanent holders will be installed soon.

Mayor Danielson advised Council of a news release put out by Municipal Utilities Manager Jerry Ewert requesting city residents to run one cold water faucet in their homes and businesses to prevent water line freeze ups.  The Water Department has been dealing with several frozen water lines throughout the city.
